USCIS Announces that H-1B Cap for FY 2005 is Reached

USCIS announced, after the close of business on Friday, October 1, 2004 (the first day of the 2005 fiscal year), that it has enough cap-subject H-1B petitions in the pipeline to meet the fiscal year 2005 cap. All cap-subject petitions received after last Friday will be returned. The next date on which cap-subject H-1B filings can be accepted by USCIS will be April 1, 2005 (for a starting work date on or after October 1, 2005).

In order to avoid a year-long H-1B blackout, we strongly encourage our clients to contact their Senators and Representatives to urge them to support H-1B visa generally and, specifically, an H-1B cap exemption for graduates of U.S. universities who have earned a Master's degree or higher.
